Driving & Road Traffic Law
Under Section 5A(3) of the Road Traffic Act 1988, legal medical cannabis patients have a statutory medical defense against the prescribed THC blood limit, provided:
- The medication was validly prescribed by a GMC-registered specialist doctor.
- It was taken strictly in accordance with your prescribing doctor's instructions.
- Your ability to drive is not impaired. (Driving while impaired remains illegal under Section 4).
Public Venues, Events & Workplaces
Medical cannabis patients are protected under the Equality Act 2010 against discrimination regarding registered health conditions:
- Venue Access: Venues, stadiums, and theaters must make "reasonable adjustments" to allow you to carry and administer prescribed medication.
- Workplace Rights: Employers cannot treat prescribed medical cannabis differently from other controlled prescription medications (e.g., opiates), provided it does not compromise workplace safety.
- Vaporizing vs. Smoking: Venues must permit dry herb vaporizing in designated areas or private spaces.
Law Enforcement & Police Interactions
If stopped by police officers, remain calm and present your statutory verification clearly:
- Keep flower or oil in its original dispensing container featuring the official pharmacy prescription label with your name.
- Provide a digital copy of your current Clinic Prescription Form (FP10) or clinic portal proof.
- Present valid photo identification matching the name on your dispensing label.
Domestic & International Travel
Carrying your prescribed medication while traveling requires preparation:
- UK Domestic Flights: Legal to carry in hand luggage on domestic flights (e.g., Loganair, easyJet) with original pharmacy tubs and prescription letter.
- International Travel: Requires explicit clearance from the destination country's embassy and a travel letter from your clinic issued at least 2–4 weeks in advance.
- Never transit through countries where medical cannabis remains strictly illegal.
